The Spilled Semen Amendment – Every Sperm is Sacred

Despite using both the words “semen” and “sperm” in the title, this is not really a humorous post.

About 6 months ago, I wrote about Mississippi’s proposed law related to when “personhood” was established.  Mississippi’s proposal, which was rejected by voters,  would have declared a fertilized human egg to be a legal person.  It seems Mississippi was not alone – Oklahoma had a similar personhood proposal which annoyed State Senator Constance Johnson.   Oklahoma’s bill, as told by Jezebel.com:

“… sought to define human life as beginning at the moment of conception, before it’s even implanted in the womb, and offers full legal protection to those tiny multicelled lumps. In the words of the bill, “the unborn child at every stage of development (has) all the rights, privileges, and immunities available to other persons, citizens, and residents of this state.”

So Johnson wrote an amendment to the bill to highlight the insanity:

However, any action in which a man ejaculates or otherwise deposits semen anywhere but in a woman’s vagina shall be interpreted and construed as an action against an unborn child.”

Johnson’s amendment was, of course, satirical*, and sought to illustrate the insanity she saw in the bill:

“My amendment seeks to draw attention to the absurdity, duplicity and lack of balance inherent in the policies of this state in regard to women. Oklahoma already incarcerates more women than any other place in the world. Under the latest provisions, a woman in Oklahoma may now face additional criminal charges and potential incarceration for biological functions that produce or, in some cases, destroy eggs or embryos, such as a miscarriage. In vitro fertilization, involving the fertilization outside the womb for implantation into the womb, would also potentially represent a violation of the proposed Personhood statute. “

It turns out that the Oklahoma bill (sans Johnson’s amendment) “easily” passed the State Senate, and is headed to the State House of Representatives.

The Daily Show’s Al Madrigal had a great segment on the bill and the amendment last night (embedded here)
